New Attorney For Mark Hazelwood Asks 2 More Weeks To Prepare Motion For New Trial

The new attorneys for former Pilot president Mark Hazelwood are asking for an additional two weeks to prepare a motion for a new trial.

Hazelwood was convicted of fraud charges and is on house arrest in Knoxville while awaiting sentencing in August.

Attorney Bradley Henry, of Knoxville and New York City, is asking that the deadline be moved from June 22 to July 6. He replaced attorney Rusty Hardin, of Houston, who was the counsel for Hazelwood during a three-month trial in Chattanooga.

Judge Curtis Collier on Thursday granted a request for filing of a motion for a new trial.

Attorney Henry said, "This case has been ongoing since, at least, April 2013, approximately five years. During that time, the government investigated, Pilot conducted an internal investigation, multiple individuals were charged, and a jury trial occurred over the course of approximately three months.

"On the same day the request for extension to file was granted, counsel gained access to the discovery database. That database contains approximately 56 GB of information. Fifty six GB of information is approximately 4,200,000 pages. If we had 10 attorneys working on this, each would be responsible for reviewing and processing 420,000 pages of information over the course of approximately two weeks, not including drafting the motion.

"It will be virtually impossible for counsel to adequately review and address the issues on the current schedule.

"In addition, there are approximately 22 days of transcripts from trial, numerous pretrial hearings, and hundreds of filings that must be reviewed."

Attorney Henry also said, "Counsel is mindful of the sentencing schedule and is working diligently to review, process and categorize multiple streams of information. This request is being made in the interests of justice in order to allow counsel to review and appropriately address each issue that merits attention. An additional 14 days would allow counsel additional time to effectively present Mr. Hazelwood’s claims, although it is still a significantly short amount of time given the volume of information."

The government is opposing the request.
